Terms of Service

This Terms of Service ("TOS" or "Terms") is a legal agreement between you and Symbio Energy Partners LLC ("Symbio," "we," or "us"), governing your use of our website and related services ("Service"). By accessing or using our Service, you agree to these Terms and consent to receive electronic communications from us.

Service Description

Symbio Energy Partners LLC provides a comprehensive platform enabling residential and commercial customers to obtain information, compare options, and enroll directly with third-party Retail Electric Providers ("REPs"). Additionally, we provide energy management consulting, renewable energy solutions, battery sales, and installation services. Your electricity contracts will be directly with your chosen REP, while other energy solutions and installation services may involve direct agreements with Symbio.

User Accounts

Currently, we do not support user account creation, but we intend to introduce this feature in the near future. When available, you will be solely responsible for maintaining your account's confidentiality and ensuring security measures are followed.

Authorization to Request Usage Information

By providing authorization, you allow Symbio to request and retrieve historical electricity usage data associated with your Electric Service Identifier ("ESIID") indefinitely or until authorization is explicitly revoked. This data will be used exclusively for quoting and contract facilitation purposes. You affirm that you hold authority over the ESIID provided and agree to indemnify Symbio from any claims arising from this data request.

Revenue Model and Supplier Representation

Symbio does not charge users for accessing the Service. Our revenue is solely derived from commissions received from REPs when you enroll in their services through our platform. Compensation arrangements may influence REP visibility and placement.

REPs Contract Termination & Right of Recission

Electricity service contracts enrolled through our platform are executed directly between you and your selected Retail Electric Provider (“REP”). Please be advised that these contracts may be subject to terms and conditions established by the REP, including—but not limited to—early termination fees or other penalties for ending the agreement prior to its specified term. Symbio Energy Partners LLC does not impose these charges and is not responsible for any fees or penalties assessed by the REP.

Residential and small commercial customers may be entitled to certain consumer protections under applicable state regulations to rescind an agreement within a protection window. Below are those rights by state:

Texas Right of Recission

  • You have the right to review and, in the case of a switch request, rescind the terms of service within three federal business days, after receiving the terms of service, without penalty.

Ohio Right of Recission

  • Residential and small commercial customers may cancel their enrollment within seven calendar days following a confirmation notice from the electric utility.

License and Restrictions

We grant you a limited, revocable, non-exclusive license to access and utilize our Service for personal or internal business use only. You must not:

  • Reverse engineer, modify, or create derivative works of our Service.
  • Use automated methods such as bots or scrapers to access the Service.
  • Disrupt or damage Service performance or security measures.

Termination of Service

Symbio may terminate your access without prior notice at our sole discretion, including violations of these Terms. Termination ends your right to use our Service immediately.

Disclaimers

Our Service and content are provided "as is" without any warranties, expressed or implied. Symbio does not guarantee the accuracy, completeness, or currentness of information available through our Service.

Limitation of Liability

Symbio will not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability to you shall not exceed fifty dollars ($50) or the minimum permitted by law.

Indemnification

You agree to indemnify Symbio, its affiliates, officers, directors, employees, and agents against any liabilities, claims, damages, and expenses arising from your misuse of the Service or violation of these Terms.

Intellectual Property

Content and intellectual property provided through our Service belong exclusively to Symbio or its licensors and are protected by copyright and trademark laws.

Governing Law

These Terms shall be governed by the laws of the State of Texas.

Changes to Terms

We reserve the right to revise these Terms periodically. Updates will be posted on our website. Continued use signifies acceptance of updated Terms.
